When a relationship or marriage hits a rock, then the most prudent move to take is a divorce or separation. There are many ways that this can be done, and the commonest way across the world is through a court of law. The court listens to both sides of the divide, and then provides the next directions. Nonetheless, some spouses may reach an agreement even without going through the courts, and this is called Orange County CA Collaborative Divorce.

Each party hires a lawyer whose sole purpose is to get the most favourable outcome for their client but each keeping in mind that the process should remain as amicable as possible. This is in compliance with a participation agreement that both parties must sign.

A participation agreement is a legal document which spells out the terms under which the entire separation process must be held. It typically includes clauses that stipulate that the parties must disclose all information relevant to the separation from either side. It also stipulates that the parties will neither take the separation case to a court of law nor threaten to do so for the entirety of the process. The parties are also required to communicate honestly and respectfully until an agreement is reached and the process is concluded.

A joint divorce can however be taken to a family law court in the event that the couple is unable to come to an agreement using this joint law process. In this case the couple must dismiss the lawyers that they had hired before and find new representation for the court proceedings thereafter.

The divorce process using this type of law however usually yields results that are acceptable to both persons. While it may seem like using professionals may be expensive it is actually to the contrary of that notion mainly because the cost is in most cases directly dependent on how long it takes to come to a settlement which does not actually take long in normal circumstances.

Perhaps the greatest attribute to a collaborative settlement is the holistic approach it takes . Catering not only for the material and financial aspect but the inclusion of other professionals also takes care of the emotional and psychological aspect of the proceedings. Some of these other cadres include child specialists, financial experts, mental health professionals and other mediators.

Another also significant advantage associated with collaborative divorce is that it ensures that both parties formally agree on the various legal procedures that are most preferable, and also which can cut down on unnecessary expenses and generally simplifying the entire process. This method also allows for the negotiation of a settlement that will work perfectly and effectively for both spouses.

When all is said and done collaborative law may not entirely take away the ugliness of separation but it does, to a great extent, minimize the financial and emotional burden that the family would normally have to endure in a traditional divorce process. And in some cases allow the couple to part ways in a less hostile manner with each accepting the eventualities that face them.
